Bill could require residential educational programs to separate bathrooms by ‘immutable biological sex’

The bill, if passed, would require the facilities to segregate bathrooms, changing areas, and showers by male and female.

NASHVILLE, Tenn. (WSMV) - A bill that would require residential educational programs to designate bathrooms as male or female is moving through the Tennessee legislature.

HB 0064/SB 0472 would require programs in the state that allow minors to participate or access residential facilities to segregate the restrooms, changing areas, and showers by “immutable biological sex.”

The bill has passed through the House and at last discussion, on March 12, it was recommended for passage in the Senate and referred to the Senate Calendar Committee.

If passed, the bill would amend TCA Title 49 with the following changes:

  • Clarifies that only multi-occupancy restrooms, changing areas, and showers must be segregated by sex in elementary, middle, and secondary schools.
  • Requires residential educational programs at private schools or postsecondary and higher education institutions to segregate such areas if a program allows minors enrolled in elementary or secondary schools to stay overnight in residential facilities for purposes of the residential educational program.

It was introduced by Rep. Gino Bulso (R-Brentwood) and Sen. Janice Bowling (R-Tullahoma).
