Judge issues $10,500 fine for Airbnb host, man rents home anyway

NASHVILLE, TN (WSMV) -

A Metro General Sessions judge just handed down the largest fine ever for violating Nashville’s short-term rental law.

On Wednesday, Nashville resident Philip Jansen was given a $10,500 fine for operating a short-term rental house without a permit. Metro Codes zoning administrator Bill Herbert told News 4 Jansen’s case was an especially aggravated situation.

“He had leased this property, short-term rented this property over 100 times after the Board of Zoning Appeals had suspended his permit,” Herbert said. “Do it legally. Do it in accordance with the law.”

Records show Jansen was first caught renting his house without a permit in 2016. He appeared before the Board of Zoning Appeals in February 2017 and was told he could re-apply for a permit in June of 2017. Jansen never obtained a short-term rental permit.

“I continued operating my short-term rental because I didn’t think it was serious. I honestly did not understand if it was actually against the law,” he told News 4. “I felt like they were stifling my ability for capitalism, to provide for my family.”

When News 4 showed up at Jansen’s rental home Thursday, three tourists had just been dropped off by a taxi driver and were trying to check in after renting the home on Airbnb for the weekend. Minutes later, Jansen canceled their reservation.

“It’s difficult for me to keep track of all the bookings that we have,” he said. “Airbnb will definitely refund them. If not, I’ll write a check. I hate that they had this experience.”
