Rutherford Co. major accused of unlawfully obtaining U.S. citizenship

NASHVILLE, TN (WSMV) -

A major in the Rutherford County Sheriff’s Department has been indicted after allegedly falsifying documents claiming he was a U.S. citizen.

Terry McBurney, 47, is charged with procurement of naturalization, making false statements under oath in matters relating to his application for U.S. citizenship and naturalization status and wire fraud.

McBurney appeared before a federal magistrate on Thursday afternoon. He entered a plea of not guilty on all counts. He was released on conditions, including he not carry a gun.

McBurney was born in Ireland, according to his 2010 job application on file at the Rutherford County personnel office. He reportedly checked “yes” on the box asking if he was a U.S. citizen.

Auditors said McBurney marked “yes” to the citizenship question on two different federal immigration forms.

According to officials, McBurney submitted an application for naturalization in 2015. On Feb. 2016, McBurney was naturalized as a U.S. citizen.

If he is convicted, McBurney is facing several years in prison.

ICE- Homeland Security Investigations and the Tennessee Bureau of Investigation assisted with the investigation.

McBurney is an in-law of Sheriff Robert Arnold, who has been indicted by a federal grand jury. Arnold has been suspended without pay.
