Nashville bar owners say they're unfairly cited repeatedly for noise

NASHVILLE, TN (WSMV) -

Several Midtown business owners say they’re being treated unfairly after receiving noise complaint violations.

Channel 4 spoke to three people who own different bars on Midtown's Division Street. They are competitors but also friends. They gathered together on Monday because they have a problem.

"We're just trying to figure out what’s going on," said Steve Ford, owner of Winners, Losers and several other Nashville bars.

Recently, they have been receiving citations from Metro police for excessive noise.

Chris Sartin said he received five citations in just eight weeks.

"This city was built on music. Now is this city Music City or is it not?" said Sartin, owner of Soulshine Pizza.

"I've been on this street for almost 17 years and not one problem like that,” Ford said.

They said the change is costing them business.

"I haven't booked any bands because I'm scared to because of the noise ordinance," said Rhonda Russel, owner of Rebar.

It also has them confused. Not long ago the city placed a sign outside of Soulshine bragging about live music venues. Now the venues are in trouble with the city for having live music.

"I have no choice but to fight. I have no choice whatsoever or I'm done," Sartin said.

Metro police said they've recently received several complaints from nearby residents.

Responding officers have to uphold the law which says:

"If an establishment is conducting ‘business’ where there is noise which is ‘plainly audible’ from the closest residential property line, then it would violate the Metro ordinance."

It's unclear which residents are complaining, but apartments and condos are popping up nearby.

"We were here first," Sartin said.
