Nashville judge to hear ouster suit against Rutherford Co. sheriff

MURFREESBORO, TN (WSMV) -

A Nashville judge will preside over the ouster suit against Sheriff Robert Arnold ahead of his jury trial early next year.

According to The Daily News Journal, Chancellor William Young of Nashville has agreed to hear the suit after all judges based in Rutherford County and Cannon County 16th Judicial District recused themselves.

Murfreesboro attorney Michelle Blaylock-Howser filed the ouster case on behalf of 12 plaintiffs from Rutherford County who want to remove Arnold from office while he sits in jail.

Blaylock-Howser has since issued a subpoena to the Grayson County, KY, jail holding Arnold before the JailCigs trial.

The hearing for the ouster suit has not yet been set and Arnold’s attorneys have not yet responded to the suit, which was filed the day after U.S. Magistrate Judge Alistair Newbern revoked Arnold’s $250,000 pretrial bond on Sept. 28. Newbern also ordered Arnold be detained while awaiting his Feb. 7 jury trial.

Arnold, his uncle John Vanderveer and Rutherford County Sheriff’s Office Accounting Chief Joe Russell face a 13-count indictment accusing them of illegally profiting from inmates at the jail in Murfreesboro through an electronic cigarettes business called JailCigs.
