Magistrate orders Rutherford County Sheriff Robert Arnold to jail

NASHVILLE, TN (WSMV) -

Rutherford County Sheriff Robert Arnold was lead away in handcuffs from a federal courtroom on Wednesday morning.

U.S. Magistrate Alistair Newbern revoked his bond on Wednesday after hearing an afternoon of testimony on Tuesday.

She said she heard sufficient evidence that he intentionally harassed Megan Arnold, his wife, after assaulting her during an incident the night of Labor Day.

She expressed concern that Robert Arnold was using the authority of his office for intimidation.

“I do not believe he is likely to abide by the conditions of his release,” the judge said.

Rutherford County Mayor Ernest Burgess said Deputy Chief Randy Garrett, per state law, would run the day-to-day operations of the Sheriff's Office in Arnold's absence.

One of those conditions was that he immediately report any negative contact with law enforcement.

Two deputies went to Arnold’s Murfreesboro home on the night of Sept. 5.

Robert Arnold did not report that when he went for his regularly scheduled probation hearing that week.

The judge ordered Robert Arnold to be detained until his trial in February on 13 federal charges, including fraud.

The judge also said had Robert Arnold chosen to resign his position, she would not have ordered his bond to be revoked.

She was concerned that as long as he was in office, he would continue to his use his power for his personal gain.

Federal prosecutors argued on Tuesday that Robert Arnold should be jailed without bail until his fraud trial because of the domestic incident against his wife.

His defense attorney said there is no proof and pointed out that Megan Arnold was not there to testify against him.

The judge said Robert Arnold will be kept separate from other inmates.

The marshals service said they do not disclose where they are taking inmates who are awaiting trial. That information is public for someone who is convicted.

The Rutherford County Sheriff's Office issued the following statement:

Chief Deputy Randy Garrett said the Rutherford County Sheriff’s Office has a dedicated staff who will continue to serve the citizens of Rutherford County.

In Sheriff Arnold’s absence, Chief Deputy Garrett will oversee operations of the Sheriff’s Office.
