Lawmakers call for Rutherford county sheriff to step down

NASHVILLE, TN (WSMV) -

Can you be charged for breaking the law one day and enforce it the next?

Legally yes, but Tennessee state Senator Jim Tracy says ethically "No."
"With everything going on I don't think he can be effective for the sheriff of a county of over 300,000 citizens.  I think it's time for him to step aside" says Senator Tracy. 

Tracy along with Senator Bill Ketron are calling on Sheriff Robert Arnold to step down.

If he chooses not to he could only be forced out by a conviction or an ouster lawsuit.

Tennesseans Against Corruption is currently working on a lawsuit but it hasn't been filed yet.

Sen. Tracy feels until all of this is ironed out someone else should take over. 

"We've got people here that are qualified to be the sheriff and let them do that" says the Senator.

Brad Turner with the Board of Commissioners and Ethics committee agrees.

"I think  for the good of the community and for what the perception is he needs to give serious consideration to resigning his position" says Turner.

County Mayor Ernest Burgess says it's an option the sheriff should seriously consider..
"I think it is going to be stressful for him and for all of the members of his team that are down there with the sheriff's office, and even others of us that are not actually there but have to work with him on a routine ongoing basis" says Mayor Burgess.
