NASHVILLE, TN (WSMV) -

One of the four former Vanderbilt football players accused of raping an unconscious student took the stand on Friday.

Brandon Vandenburg said in court that he wants one of his attorneys to stay on his defense team despite the fact the prosecution says that attorney should be disqualified due to a conflict of interest.

The prosecution wants California attorney Albert Perez Jr. thrown off Vandenburg's defense team after two witnesses came forward to say Perez tampered with and destroyed evidence in the case.

Vandenburg signed a sworn statement on Friday saying that despite the alleged conflict of interest, he still wants Perez to represent him.

Perez denies the allegations.

"It's absolutely not true. It's made up. To divert the defense of Mr. Vandenburg, they focused on me, and it's absolutely made up," Perez said.

Recently, Vandenburg's defense team recently fired back, filing a motion to have the prosecutor thrown off the case for "over-reaching."

"We will make comments, obviously in court, about it. I think, as Proverbs says, a wise man keeps a silent tongue and mouth and doesn't get in trouble," said prosecutor Tom Thurman about the recent motion to disqualify him.

The judge will have the final say on whether or not Perez stays on the case.
