An administrative law judge has sided with Hamilton County schools in a case involving the placement of a student with special needs whose mother said he was denied a free and appropriate education.
Deborah and Greg Hyde, acting as their own counsel, argued in October that their son Luka was transferred from Normal Park Lower School to Red Bank Elementary, against their wishes. The school district had argued that Red Bank was better equipped to implement the child's Individual Education Plan. The Hydes later enrolled their son in a private school, and had asked the school district to reimburse them for his tuition.
Administrative Judge Marion Wall wrote "the proof does not support this allegation," and adds, "the position of Hamilton County Schools is more persuasive."
In earlier interviews, Ms. Hyde had indicated she would seek an appeal if the ruling was not in her favor. The judge said the family would have sixty days to file such an appeal.
