FIRST ON 3: Montalvo speaks about arrest at UTC

Students at UTC say a controversial evangelist is disrupting the campus and on Monday they were out protesting against her.

The response comes after a student was arrested last Thursday. He says he was just trying to ask the woman some questions, but police say he did not follow orders. Students say they are outraged 24-year-old Cole Montalvo is facing charges of disorderly conduct, resisting arrest, obstruction of justice and inciting to riot. He says the officer's actions were over the top.
 
"I think they did their job according to Romans 13. It's not my say if they went too hard or not. It's not my job. I'm not a cop. I wouldn't know what to do. I'm a preacher," says Angela Cummings.

Angela Cummings says it is not her fault 24-year-old Cole Montalvo was arrested while she preached.

"I go with whatever the campus wants to do. If they set up rules, I'm going to go by their rules. And the students should go by the school's rules too," says Cummings.

Cell phones recorded as officers took Montalvo to the ground. Montalvo used his phone to record himself in the back of a cop car, saying, "I tried to walk up to her and ask her why she was calling us sinners? Why she's trying to get us to repent by yelling at us? Ridiculous stuff like that. And apparently, that's illegal and I was arrested for doing so."

Monday, students were out protesting against Cummings. As for Montalvo, he still has a few scrapes from the scuffle.

"Before I really knew what was going on I was on the ground, handcuffed, being maced."

Montalvo says he never saw the cones set up to give Cummings her space.

"I think the charges are a little ridiculous. They got me on inciting a riot, as well as three other things. I think if anyone was inciting a riot, it would probably be the preacher lady," says Cummings.

"I wish he would have just obeyed," says Cummings.

Cummings is used to controversy and admits she calls people sinners.

"Chattanooga wake up! Wake up! People are going to hell. Please get out and spread the good news of Jesus Christ. Get off your Lazyboy and preach the gospel," says Cummings.

"I don't think we should come out and channel this hate against this preacher lady. I think we need to open a discourse as to what is an appropriate response," says Montalvo.

UTC says it is investigating the arrest to see if proper procedure was followed. Channel 3 also asked school officials about students complaining about the noise of Cummings' preaching. A spokesperson says so far there have been no documented complaints to the Dean's Office while the preaching is going on. Officials say that is they only way they can approach Cummings, if there are documented concerns through the Dean's Office.
