Davis buried his wife, Patsy, in their front yard in 2009.
STEVENSON, AL (WAFF) -
The Stevenson man whose wife's body is buried in the front yard of his home has come up with a new way to fight to keep her there.
Last week, the Alabama State Supreme Court denied James Davis' appeal to keep his wife's body in his yard. He buried his wife, Patsy, there in 2009, despite the objections from the city council. Davis has filed several appeals and fought since then to keep Patsy's grave where it is.
Davis hopes to take his case before a federal judge after losing to the state supreme court. He believes churches have special protections under the law and is in the process of converting his home to a church.
He plans to ask the circuit judge for up to six months delay in her ruling to give him time for the case to go to the federal court.
Davis said if he is forced to remove her body, she will be reburied at the same site legally.
"Forever more, that is my gravesite. People passing by won't know she's not there. And she won't be because I'm going to cremate her. They can't stop me from cremating her and putting her back, and that's where she'll go," he said.
