JONESBOROUGH, Tenn. (AP) - A former East Tennessee State University basketball player has been released from custody after a judge ruled that a postal employee's search of a package was illegal.
Washington County Criminal Court Judge Stacy Street found that the employee at the campus post office had no reason to open the package sent last year to 25-year-old Marcus DuBose and dismissed the charge of possession of marijuana for resale.
The Johnson City Press reported (http://bit.ly/1gLQk1x ) that DuBose, from Hartsville, S.C., walked out of court a free man after Thursday's ruling.
DuBose and his roommate, Sheldon Cooley, were each charged in the case. Both men played at East Tennessee State University, but were ultimately expelled from school.
Prosecutors dropped a charge against Cooley earlier this year.
