Metro councilman says SWAT arrest for TWRA citation shows flaw

A Metro Council member said the legal trouble he recently experienced is an example of a flaw in the system.

Councilman Duane Dominy appeared in court Thursday on a misdemeanor boating violation.

"There's a whole system of errors, and mistakes and misunderstandings that have occurred. And what's happened has happened. I figure why not make the best of it and learn what we can and improve the system," he said.

Dominy received a ticket in June for towing a raft behind a jet ski without any mirrors on it. Dominy then missed his court date because the ticket got wet and the date was smudged.

But because he missed his court date, the misdemeanor charge turned into a felony warrant. And those warrants are served by SWAT team members, so they arrested Dominy at his home.

Metro police say what shows up on the officers' computer is that they're serving a felony warrant, and they don't have the background on the case.

Dominy's attorney says that needs to change, because while the councilman's issue was pretty minor, others may not be.

"It could've been somebody dangerous. It could've been some sort of assault or some sort of drug crime, and they didn't appear either. The police need to have that information ahead of time. They need to let them know what the underlying charge is when they come in to pick them up on a failure to appear, because apparently all they see is 'failure to appear. Go get them'. And it's something that needs to be fixed in the system," said attorney Adam Dread.

Under the plea entered Thursday, Councilman Dominy will take a boating safety class and pay a $50 fine.
