GALLATIN, Tenn. (AP) - A federal appeals court has dismissed lawsuits from parents claiming a Sumner County teacher's treatment of five special needs students amounted to child abuse.
The opinion published Tuesday by the 6th U.S. Circuit Court of Appeals in Cincinnati said legal briefs filed for the parents were so deficient and late that it had to dismiss the case.
The ruling leaves open the possibility the parents could be ordered to pay the legal bills the Sumner County school board incurred defending against the lawsuit.
The parents sued teacher Donna Weidenbenner and the school system over incidents from 2009. Before the case went to trial, a lower court dismissed it, citing "scant evidence" that Weidenbenner had used excessive force against students.
