FRANKFORT, Ky. (AP) - A panel from the Kentucky Court of Appeals is considering the case of a man whose penis was amputated during what was scheduled as a circumcision.
Judges Janet Stumbo and Donna Dixon seemed skeptical Tuesday of Dr. John Patterson's claim that a pre-surgery waiver gave him the authority to do whatever he deemed necessary during the surgery on Phillip Seaton of Waddy.
Patterson found cancer in Seaton's penis during the October 2007 procedure and removed most of the organ without getting specific consent to do so. Seaton sued, but a Shelby County jury found in favor of the doctor after a trial in 2011.
During arguments in Frankfort, Seaton's attorney, Kevin George, told the judges the medical consent form was overly broad and jurors were not properly instructed.
