Court denies appeal from Wayne County school board
NASHVILLE, Tenn. (AP) - A federal appeals court has denied an appeal made by the Wayne County Board of Education in a case involving two students who were bullied and awarded $100,000 each.
The U.S. Court of Appeals for the 6th Circuit on Thursday affirmed a lower court ruling to deny a motion for judgment filed by the school board.
Two Waynesboro Middle School students, who are not identified in court records, were subjected to sexual harassment by their basketball teammates in 2008. One student was sodomized with a marker and another was tricked into doing a blindfolded sit-up while another student stood above his face with his pants down.
The families of the students filed a lawsuit under Title IX that claimed the school was deliberately indifferent to the harassment.
