Judge declares mistrial in M'boro baby death

MURFREESBORO, TN (WSMV) -

Rutherford County prosecutors are still considering their next step after a mistrial in the death of a child.

In court Tuesday, the judge declared a mistrial after 10 hours of deliberation on the murder charge against 33-year-old Rashii Brisbon.

He was accused of shaking 16-month-old Kymari Clark, causing the injuries that killed him.

The jury did convict Brisbon of aggravated child abuse, but they couldn't reach a verdict on the murder charge.

The Daily News Journal reported that the prosecutor may present the case a second time, but they are waiting until after Brisbon's Jan. 9 sentencing date on the child abuse conviction.
