Murfreesboro mosque lawsuit back in court

MURFREESBORO, TN (WSMV) -

Opponents of an Islamic center were in a Murfreesboro court Wednesday morning in an attempt the stop the construction of the building.

The Murfreesboro Post newspaper was allowed to intervene as a plaintiff in the suit.  The attorney for the Post, David LaRoche, said the newspaper wanted to intervene because Kevin Fisher and the 14 other plaintiff have contended that the Post is not a newspaper of general circulation.  

Because of this, mosque opponents feel proper notice wasn't given when the Rutherford County Regional Planning Commission voted to approve the site plans for the Islamic Center.  

Judge Robert Corlew III has set April 25, 2012 at 1 p.m. for the open meeting trial.   The plaintiffs attorney Loe Brandon did not object to the paper intervening as a plaintiff.  

Opponents of the mosque development on Veals Road filed suit more than a year ago after planning commissioners approved the project.

In late September, the Islamic Center of Murfreesboro broke ground on the first phase of the development and construction work has since begun.

Still at issue for mosque opponents is whether public officials provided proper notice about the meetings leading up to approval of the plans.
