Occupy protesters arrested... again

NASHVILLE, TN (WSMV) -

Tennessee state troopers arrested Occupy Nashville demonstrators at Legislative Plaza for the second time early Saturday.

Officers moved into the square at about midnight to enforce a new 10 p.m. curfew.

About two-dozen protesters were taken into custody.  Metro Night Court Commissioner Tom Nelson ordered their immediate release.  Nelson's decision is raising questions about the state's ability to enforce the curfew.

Twenty-nine demonstrators were arrested outside the Sate Capitol on Friday.  Nelson refused to jail the group, saying the state acted too hastily.

The demonstrators were released after being issued misdemeanor citations.

"The Department of Safety and Homeland Security took the appropriate action to support the state's revised policy that the Legislative Plaza is not to be used at night without specific authorization," Dept. of Safety Commissioner Bill Gibbons said on Friday.

"It is our responsibility to keep the protesters safe on state property, along with citizens who work, live and enjoy downtown," Gibbons said.
