Shot Officer Sues Prison Company For $14 Million

Mark Chesnut Shot Multiple Times In June Along I-40

A Metro officer who was shot multiple times in June by an escaped Mississippi convict is now suing the company that operated the prison where the inmate was serving time.

Sgt. Mark Chesnut was shot along Interstate 40 in west Nashville on June 25 after he pulled over a car driven by Courtney Logan and Joseph Jackson.

Jackson escaped from police custody in Mississippi during an eye appointment with the help of Logan, his cousin.

Chesnut's attorney, David Raybin, confirmed that his client filed a lawsuit Friday suing Corrections Corporation of America for $14 million.

According to the lawsuit, Jackson was given two weeks advance notice of the appointment and was able to access a cell phone to plan the escape with Logan.

The weapon used to shoot Chesnut was taken from one of the CCA guards who accompanied Jackson to the appointment.

Chesnut's attorney said the entire incident wouldn't have occurred if CCA hadn't been negligent with its policies.

"I could not imagine a scenario where they did everything possible to assist this person in escaping," said David Raybin. "They gave him advance notice. They gave him virtual access to cell phones, firearms, did nothing to prevent this escape with predictable results."

Steven Owen, a spokesman for the Nashville-based prison operator, said that it has not yet been served with a lawsuit and would not comment.

CCA has 30 days to respond to the lawsuit.

Chesnut's wife, Michelle, is also seeking $2.5 million.

Jackson was serving a life sentence at the Delta Correctional Facility, a CCA-run prison in Greenwood, Miss., for armed robbery and aggravated assault. Police have testified that Jackson confessed to shooting Chesnut.

Logan and Jackson were driving on Interstate 40 near Nashville when Chesnut pulled them over for a routine traffic stop. As he was checking the tags on the rental car and Logan's license, police said Jackson walked up and opened fire from the passenger side.

Chesnut was wearing a bullet-resistant vest but was wounded in the abdomen through a part of his body that was unprotected.

According to the lawsuit, Chesnut put the car in reverse and was able to call for help and give a description of the two men and their vehicle. The two were quickly arrested.

Chesnut is continuing his recovery. Raybin said the officer will return to light duty with Metro police on Monday.
