A Robertson County judge on Friday agreed to throw out a charge against a former Portland teacher accused of having sex with a former student.

The judge threw out the charge against Sandy Binkley based on the possibility that the alleged victim might have been 18 if and when the sex took place at her home.

A jury last month found Binkley was guilty of two counts of sexual battery by an authority figure. She was acquitted on seven of nine counts in the case.

Those encounters happened at the school, but Binkley was also charged with having sex with one of the victims at her home in Robertson County.

The boy involved in the Robertson County charges was the same person who Binkley said raped her, a defense the jury didn't believe at the Sumner County trial.

Binkely is set to be sentenced in the Sumner County case next month.
