Teacher/Student Texted After Alleged Rape, Say Prosecutors

Prosecution: Student Had Cell Phone Pics Of Sandy Binkley's Panties After Sex

The Facebook page of a former Portland High School teacher accused of having sex with three students was introduced by the prosecution team during her trial on Monday.

Sandy Binkley testified that the sex she had with one of the three students at Portland High School in 2008 was rape.

In one Facebook posting in August 2008, five months after she was allegedly raped by a student, Binkley was still communicating with him via text message and Facebook, the prosecution said. In one post, said the prosecution, Binkley asked the student, "What have you been telling all your friends about us? They're hitting on me."

The prosecution said the student had shown to a friend cell phone pictures of Binkley's panties on the floor after they had sex.

Binkley said the alleged rape occurred in March 2008 when she was grading papers in a volleyball coach's office when a boy came in. She said she asked the student, who was her teacher's aide at the time, if he wanted to help grade the papers. She testified the student said, "I have a better idea" before he turned off the lights and closed the door.

"He was kissing me. I told him to stop. He said, 'It's going to happen today,'" Binkley said.

She said the boy then forced her to the floor for oral sex then raped her on top of the desk. She said afterward, she went into the bathroom, locked the door and sat on the floor crying. She debated reporting the attack to the police but did not because she was afraid that authorities would not believe her.

"I wanted it to be over. I wanted to bury it," Binkley said. "I put on a happy face like I've always done. I learned early that you just deal with what you're given and just go on."

She testified her father was an alcoholic who beat her mother. Binkley said she had been raped before, at age 14, but never told anyone. She did not say who raped her.

On Monday afternoon, the prosecution pointed out that the teacher and the boy continued to exchange 18 text messages later the afternoon of the alleged rape. Binkley never reported the alleged rape until days later, when she was being interviewed by a detective about her alleged sexual relationship with the students.

Last week, the student who Binkley said raped her testified he and Binkley had sex voluntarily in her classroom closet. The Tennessee Bureau of Investigation found a condom wrapper in that closet.

"I don't know what to say about the condom wrapper," Binkley said Monday.

A computer expert who examined Binkley's cell phone records for the defense team also took the stand on Monday morning.

Kailen Goddard, a computer expert, found the texts and calls Binkley sent to the three male students with whom she is accused of having sex. Those messages are a small percentage of the total calls and texts she made.

The prosecution showed last week that Binkley made more than 3,000 calls and texts to the students with whom she allegedly had sex.
