Lawmaker Wants Age Limit On Private Gun Sales

Larry Baity of Gun City has been selling guns for decades and knows what's necessary to complete the transaction.

"This is a highly regulated industry, the firearms industry, and you must meet certain criteria," said Baity.

There's a background check if you buy a gun from a licensed dealer, and you have to be 18 years old to buy a rifle or shotgun and 21 to buy a pistol.

But those rules don't apply if you buy your gun from a private owner.

That's how, police said, 20-year-old Sahel Kazemi bought the gun she used to kill Steve McNair and herself.

"It's too easy to get access to guns," said State Rep. Brenda Gilmore, who calls this issue an eye opener. She wants to come up with legislation to impose an age limit on private sales, possibly requiring a signed affidavit to guarantee the buyer is more than 21.

"As the seller, I should have to assume some responsibility to make sure that who I'm selling it to is actually old enough and responsible enough to handle that gun," Gilmore said.

But some say casual sales aren't causing widespread problems and are impossible to try to enforce.

"I could see a bill being filed, because there have been lots of bills filed that have been bad ideas, but I don't see much chance of it passing," said John Harris, president of the Tennessee Firearms Association.

Baity said the state shouldn't try to impose restrictions on private sales but that in this case, the seller should have known better.

"The person ... who sold this to her should have had better judgment," said Baity. "She's underage."
