Home Builder Sued Over Fraud Allegations

There is a sense of panic among several homeowners in Clarksville after Channel 4 exposed how one of the city’s largest developers is being sued over fraud allegations and has filed for bankruptcy.

Many residents are wondering if they could lose their homes.

The Wengers are among an unknown number of homeowners in Clarksville who fear the worst.

"I can’t even sleep. I’m so stressed out over it," said Maria Wenger.

All of the concerned residents’ homes were built by Bill Mace, who filed for bankruptcy after being sued on fraud allegations.

"We could lose this house. I don’t have the money to pay his construction loans," Maria Wenger said.

The I-Team first exposed an alleged scheme between Bill Mace Homes and an employee of Stewart Title.

A lawsuit filed by Stewart Title claims one of its employees working for Title Connection didn't use buyers’ checks to pay off Mace's construction loans on their homes and directed the checks to Mace's personal account so he could continue building other homes.

Homeowners like the Wengers who didn't buy title insurance could be forced not only to pay for their mortgage but also for Mace's construction loans.

Five Bill Mace Homes homeowners who recently closed on their homes closed with Title Connection.

"We were told we have to close with Title Connection," Maria Wenger said.

Mace had no comment for either of the I-Team’s stories.

Homeowners are scrambling to try to save homes they thought they just bought.

"I can't believe this can happen. How can one person or two mess up so many people?" Maria Wenger said.

Neither Mace nor Yvette Caira, the employee with Title Connection named in the lawsuit, face any criminal charges.

The U.S. attorney’s office would not comment on whether or not the office is investigating.
